1. Two-Year Cufflinks Guarantee
All cufflinks manufactured by John Pinder Ltd and sold under the brand names Cuffs & Co or John Pinder come with a manufacturer's replacement guarantee. We will replace cufflinks purchased directly from us should they fail due to faulty manufacture within two years of the purchase date. Where the original item is no longer stocked, a suitable replacement to the same value of the item(s) purchased will be offered (based on the price paid on the date of purchase). Proof of purchase may be required, this guarantee does not affect your statutory rights. If you purchased Cuffs & Co or John Pinder cufflinks elsewhere, then in the first instance please contact the retailer who will offer the same guarantee on our products.
2. Governing Law and Contract Formation
All transactions on this site are conducted under English and Welsh Law and any dispute will be settled under the jurisdiction of the English and Welsh courts. The following information details the process of how a contract with us is formed. Our website provides you with an invitation to treat. Firstly, you place the order for your products on the website by pressing the "submit order" button at the end of the checkout process, this sends your offer to purchase at the invitation price to us. Following this we will send to you an "Order Confirmation" email detailing the products you have asked to purchase. The "Order Confirmation" email is not an acceptance of your order by John Pinder Ltd but an acknowledgement to let you know that we have received your offer to purchase our item(s). At the same time that your product is shipped from our warehouse we will send you a "Despatch Confirmation email. Once we send you a "Despatch Confirmation" email we have accepted your offer to purchase the item(s) and a fully binding contract is made. Order acceptance and the completion of the contract between you and us will take place on the despatch to you of the products you asked to purchase unless we have notified you that we do not accept your offer to purchase or you cancel your offer to purchase. Non-acceptance of an offer to purchase may be a result of; (i) the product(s) you asking for being unavailable from stock, or (ii)our inability to obtain authorisation for your payment, or (iii) the identification of a pricing, product or offer description error on our website.
3. Refusal of Transaction
We reserve the right to withdraw any products from this website at anytime and/or remove or edit any materials or content on this website. We may refuse to process a transaction for any reason or refuse service to anyone at any time at our sole discretion. We confirm that John Pinder Ltd is an equal opportunity company and we do not discriminate against anyone for any reason. Transactions will be refused within the extent of the law. We will not be liable to you or any third party by reason of our withdrawing any product from this website whether or not that product has been sold; removing or editing any materials or content on the website; refusing to process a transaction or unwinding or suspending any transaction after processing has begun.
4. Time of the essence
No orders or contracts formed with John Pinder Ltd are deemed to be of a "time of the essence" nature when our standard delivery is selected. We do not guarantee delivery times. If you choose our Express Delivery service for delivery within the UK then, if your order is accepted before 2pm on a working day (and you have received your delivery order confirmation email by this time), we will ensure that your items are passed to Royal Mail for delivery by its Special Delivery service for delivery to you the next working day. We have no control over the delivery of items by Royal Mail and we are dependent on Royal Mail meeting its obligations to John Pinder Ltd to deliver you items on time. John Pinder Ltd expressly exclude any liability for damages for circumstances outside of its control such as delivery company losses, strikes. If you wish to ensure that your order will be received within a specified time period then you are invited to call our customer service number on 0800 612 9510. Our Express Delivery option to the rest of the world does not have a time guaranteed service.
5. Returns
To return an item simply call us on 0800 612 9510, and one of our customer support team will assist you with information on how to return your item to use. Under the European Distance Selling Regulations (DSRs), customers in the European Union that cancel a contract for purchase of an item(s) within 7 days of receipt of their order will receive a refund for the cost of the item(s) and the cost of sending the item to you, provided that the entire order is being returned. Please note, the cost of gift wrapping will not be refunded. Item(s) are to be returned in their original condition or a deduction for damage will be made to the refund tendered as a restocking fee. After this period we are happy to offer an exchange for a product of equal or greater value within a period of 90 days, this excludes all wedding and birthday cufflinks. When returning an item, we cannot be held responsible for packages lost in transit: as you are responsible for returning the item(s) to us, please ensure you get proof of postage and ensure that you have purchased the adequate level of insurance from the courier or mail company you use when returning an item to us.
